GP LOCUM AGREEMENT – THE CONTRACT BETWEEN BOOKAMED AND GP LOCUM

 DEFINITIONS

 

Agreement” or the “Terms” means the terms and conditions between Bookamed and the GP Locum under this Agreement.

 

"Bookamed” means Bookamed Limited (Company Number: 10152215), a company incorporated in United Kingdom and having its office at 160 Kemp House, City Road, London EC1V 2NX, United Kingdom.

 

Client” means an individual, partnership, LLP or corporate body together with any subsidiary or associated company as defined by the Companies Act 2006 requiring services of the GP Locum.

 

Data Protection Laws” means the Data Protection Act 1998, any applicable statutory or regulatory provisions and all European Directives and regulations in force from time to time relating to the protection and transfer of personal data.

 

Engagement” means any appointment of the GP Locum directly by the Client on a temporary basis, whether under a contract of service or for services.

 

GP Locum” means the individual general medical practitioner providing his/her services to the Client for relevant Engagement.

 

Platform” means the Bookamed website, i.e., www.bookamed.com and/or mobile application, through which GP Locum can register for suitable Engagements.

 

Services” means the work of a GP Locum in relation to the Engagement.

 

Subscription Plan” means either the Basic Subscription Plan or the Premium Subscription Plan provided by Bookamed. The details of the Subscription Plan are attached as Annexure 1.

 

1. TERMS

 

1.1. These Terms shall govern the relationship between Bookamed and the GP Locum. For the avoidance of doubt during Engagements the terms of the Engagement will be agreed directly between the GP Locum and the Client and Bookamed shall have no involvement in this matter and these separate terms.

 

1.2. For the avoidance of doubt, these Terms shall not give rise to a contract of employment or for services between Bookamed and the GP Locum and nor shall it create or be deemed to create a partnership or a relationship of principal and agent between Bookamed and the GP Locum.

 

1.3. By using the Platform the GP Locum agrees that he/she has read, understood and agrees to these Terms.

 

 

2. SERVICE

 

2.1. Bookamed shall, acting as an Employment Agency within the Conduct of Employment Agencies and Employment Businesses Regulations 2003 and associated legislation, as amended from time to time, provide employment agency services to the GP Locum with no cost to the GP Locum for registering, searching, and applying for vacancies. However, a GP Locum registered under the Basic Subscription plan may at any time request for any additional services as provided under the Premium Subscription Plan. Bookamed shall levy a non-refundable fee of £ 10 per month from the GP Locum for providing such additional services. The GP Locum shall be charged £10 per month until the end of the subscription period, unless the GP Locum cancels the paid subscription on the subscription page or calling Bookamed Customer Service Team before the end of the current subscription period. The details of the services under Basic Subscription Plan and Premium Subscription Plan are provided under the Annexure -1 herein. If the GP Locum who is registered under the Basic Subscription Plan requests Bookamed for services under the Premium Subscription Plan the GP Locum shall subscribe to the Premium Subscription plan via the platform or calling Bookamed and consent to Bookamed payment terms and conditions. The provision of services under the Premium Subscription Plan is not a condition of the work-finding services provided under the Basic Subscription Plan.

 

2.2. Bookamed reserves the right to offer Subscription Plan at its sole discretion to GP Locum at a discounted price and the GP Locum shall be liable to pay the discounted price offered by Bookamed. However, all other terms shall remain same as per these terms and condition laid out herein.

 

2.3. Once the GP Locum has registered on the Platform he/she will be able to browse opportunities and will be solely responsible for finding and applying for a suitable Engagement on the Bookamed Platform. Whilst Bookamed requires its Clients to ensure that on the Platform is complete,all information provided by them accurate and up-to-date, Bookamed does not provide any warranty or guarantee of any kind that the assignment opportunities posted by Clients are complete, accurate and up-to-date.

 

2.4. Bookamed does not guarantee the selection of the GP Locum by any Client, and the Client shall have the sole discretion to select any GP Locum from the Platform. Bookamed shall not refer, recommend and endorse either a Client or a GP Locum.

 

2.5. The Client will engage the GP Locum directly and will be responsible for compliance with all applicable legislative provisions including but not limited to employment law, National Health Service (General Medical Services Supplementary List) Regulations, 2001, Employment Rights Act, 1995, Working Time Regulations, 1998, National Health Service (Primary Care) Act 1997 and other similar laws. The GP Locum understands that Bookamed shall not be responsible for any Engagement or employment decisions made by the GP Locum or the Client as these are matters to be determined by them and further that Bookamed is not a party to and does not have any obligations in respect of the agreement between the GP Locum and the Client in respect of an Engagement.

 

2.6. The GP Locum hereby agrees to abide by the policy and guidelines of the Client for performing its Services during the Engagement. The Client may upload the policy and guidelines at the time of listing the vacancy. In the event the policy is not provided on the Platform, it shall be the duty of the GP Locum to request the policy and guidelines set in by the Client on arrival at the Client’s premises. Bookamed shall not in any event be liable in case the policy already uploaded on the Platform by the Client is outdated or for failure on the part of the GP Locum to request such policy from the Client on arrival at Client’s premises.

 

2.7. The GP Locum understands and accepts that he/she will undertake Engagements solely based on such terms agreed between the Client and the GP Locum. The GP Locum agrees that Bookamed will have no obligations towards him/her in respect of such terms and/or remuneration for any Engagement. The GP Locum also agrees that Bookamed will have no responsibility for any tax/national insurance deductions from such remuneration.

 

2.8. Bookamed shall not responsible for any loss relating to you, the Locum, by not complying with any tax reporting requirements when directly engaging with a Client. Bookamed encourages the Locum to carry out its own due diligence for all engagements. Any responsibility of the Locum in respect of deductions for any taxes including income tax, national insurance, VAT and corporation tax accounting to HMRC shall be fully discharged by the Locum and the Locum agrees to regularly perform relevant checks against these responsibilities.

 

2.9. For the avoidance of any doubt the Locum agrees to declare if the Locum is registered for VAT, including when the Locum have met the relevant threshold tests to register and account for VAT from all relevant incomes, and not just engagements arranged through Bookamed.

 

2.10. The GP Locum on a Premium Subscription hereby agrees that Bookamed shall only be responsible for generating invoices on behalf of the GP Locum and it shall be the sole responsibility of the GP Locum to collect the payments from the Client directly. The GP Locum on a Basic Subscription hereby agrees to generarte their own invoices and it shall be the sole responsibility of the GP Locum to collect the payments from the client directly. 

 

3. SKILLS/QUALIFICATIONS

 

3.1. When registering for the Platform GP Locums must provide certain information to enable prospective Clients to ensure the suitability of GP Locums for potential Engagements. This information includes (and is not limited to): contact details; qualifications; experience; regulatory registration information; employment history and references. Full details of the mandatory information that GP Locums must provide is detailed in Annexure 2.

 

3.2. The GP Locum warrants that the information he/she will provide in line with clause 3.1 and Annexure 2 is true, complete, accurate and up-to-date. The GP Locum understands that compliance with this clause 3 is a material provision of the Terms to ensure that Bookamed can reassure Clients that GP Locums are suitable for Engagement.

 

3.3. The GP Locum warrants that if information provided in line with clause 3.1 and Annexure 2 becomes incomplete, inaccurate or out-of-date that he/she will notify Bookamed immediately and submit appropriate revised information to Bookamed/the Platform without delay. In such circumstances a GP Locum agrees that he/she will not apply for potential Engagements until such time as the revised information is submitted and he/she can comply with clause 3.2.

 

3.4. Bookamed confirms that it will not disclose any information about the GP Locum without his/her prior consent other than it is for the purposes of: providing work-finding services; legal proceedings; providing information to a professional body of which the GP Locum is a member; or is permitted by law.

 

4. PRE-EMPLOYMENT CHECKS

 

4.1. The GP Locum shall during registration on the Platform provide the mandatory and additional details/documents and shall upload the mandatory details/documents (excluding Identity and Right to Work documents) as mentioned in Annexure – 2 herein. The GP Locum shall provide original documents for Identity and Right to Work check. Although it is not obligatory for the GP Locum to provide the additional details / documents referred to in Annexure – 2. Bookamed nevertheless recommends that the GP Locum provides such information as Clients are likely to find it beneficial.

 

4.2. Being an online recruitment company Bookamed shall use video link (such as Skype, FaceTime, etc) as the primary method to conduct identity checks and verify the Right to Work (such as their passport) document. When the video link method is used the GP Locum shall first send the original identity and Right to Work documents to Bookamed. On receipt of the documents Bookamed shall then contact the GP Locum via video link to complete the check in the presence of the GP Locum (ensure the document is genuine, photographs are consistent with the appearance of the person on the screen, etc) before copying the document as necessary and returning the originals to the GP Locum. Wherever possible Bookamed shall conduct face-to-face interviews to verify the proof of Identity and Right to Work documents. The GP Locum consents to Bookamed using additional third party tools to verify the authenticity of the original documents provided.

 

4.3. The GP Locum by registering on the Platform gives his/her consent to Bookamed to verify such information, including that the information provided by the GP Locum shall be used, stored and shared with any subsidiaries, sub-contractors, agents and third party within and outside the European Union for verification.

 

4.4. The GP Locum shall provide contact details of two referees, current or previous employers, and the referees shall not be related to the GP Locum. The GP Locum consents to Bookamed contacting the named referees in accordance with its registration and pre-employment screening process. The GP Locum understands that the referees will be contacted as part of the registration process and the GP Locum consents to Bookamed contacting the referees prior to the GP Locum’s profile being listed on the bookamed platform. Bookamed shall notify the GP Locum prior to contacting the named referees. The GP Locum consents to Bookamed forwarding the references to Clients registered on the Bookamed platform.

 

4.5. As part of pre-employment checks, Bookamed shall source and verify the GP Locums original documents. Bookamed may use additional third party tools to verify the authenticity of the original documents provided.

 

4.6. As Bookamed is not the end employer of the GP Locum, Bookamed shall not carry out DBS checks on the GP Locum. If the GP Locum is a Limited Company Contractor Bookamed shall ask the GP Locum if a DBS check has been carried out and shall obtain a copy of the DBS check under Regulation 22 of the Conduct Regulations. For self-employed GP Locums, the Client shall be responsible for completing the DBS check. In either case the Client shall be the sole authority in carrying out the DBS check. The GP Locum consents to the client directly conducting checks not carried out by Bookamed on the GP Locum and/or to any additional checks already completed by Bookamed.

 

5. REHABILITATION OF OFFENDERS

 

5.1. The Engagement under this Agreement is exempt from the provisions of the Rehabilitation of Offenders Act 1974; therefore the GP Locum shall not be entitled to withhold information requested by the Client about any previous convictions the GP Locum may have, even if in other circumstances these would be regarded as “spent” under the provisions of the Rehabilitation of Offenders Act 1974.

 

5.2. The GP Locum shall provide the Client with information about any previous convictions (excluding minor traffic offences) he/she may have undergone before commencing the Engagement. The GP Locum is not required to disclose any convictions or cautions that has been filtered under the filtering rules. 

 

5.3. During the period of Engagement, the GP Locum shall immediately disclose to the Client if he/she is subject to any criminal or traffic investigations, charges or convictions (excluding minor traffic offences).

 

5.4. Any failure to provide the required information under this Clause shall be treated as gross misconduct and may result in the termination of the Engagement.

 

6. GP LOCUM STATUS

 

6.1. The GP Locum hereby acknowledges that the terms shall not give rise to a contract of employment between Bookamed and the GP Locum. For the avoidance of doubt, the GP Locum shall not at anytime during the Engagement be considered as a worker, agency worker, agent, partner or servant of the Client or Bookamed and accordingly;

 

a. These terms shall not be considered as an exclusive arrangement between the GP Locum and Bookamed. The GP Locum shall be entitled to provide his/her services to any third party he/she may desire.

 

b. The GP Locum during the time of Engagement shall comply with the Working Time Regulations, 1998.

 

c. The GP Locum shall register his/her residential address as may be deemed necessary under the Pension Act, 2008.

 

d. The GP Locum shall solely be responsible for the payment of all taxes (including VAT), contributions towards National Insurance and any social security levies payable in respect of Services provided during the period of Engagement.

 

e. Any compliance required under the Immigration, Asylum and Nationality, Act, 2006, laws applicable to the jurisdiction in which the Services are provided shall fall upon and be discharged wholly and exclusively by the GP Locum. In case the GP Locum is subject to immigration control under the Immigration, Asylum and Nationality Act, 2006, the GP Locum hereby warrants that he/she has valid and existing leave to enter and work in the United Kingdom during the period of Engagement.

 

f. During the period of Engagement the GP Locum shall hold valid Medical Indemnity Insurance (including out of working hours cover, as may be necessary) and other insurances as may be deemed necessary. The GP Locum shall provide the details of the cover if required by the Client. The Client may decide to verify either itself or through a third party the details provided by the GP Locum and the GP Locum agrees to co-operate with the Client for such verification and shall provide any additional information as may be required by the Client.

 

g. The GP Locum shall provide its Services during the Engagement as an independent professional consultancy services to the Client. Therefore, the GP Locum agrees that it does not intend or regard the Services provided under the Engagement to fall within the scope of the PAYE regime or the AWR. In the event the nature of the GP Locum’s Services changes, the GP Locum shall notify the same to the Client in writing. 

 

h. The GP Locum agrees to keep his or her professional knowledge and skills up to date at all times.

 

i. The GP Locum agrees to regularly take part in activities that maintain and develop your competence and performance.

 

j. The GP Locum agrees to find and take part in structured support opportunities offered by the Client (for example, mentoring).

 

k. The GP Locum shall make all efforts to be familiar with guidelines and developments that affect your work.

 

l. The GP Locum agrees to take steps to monitor and improve the quality of their work regularly.

 

m. The GP Locum agrees to obtain content from the client or other valid authority before the GP Locum carries out any examination or investigation, provide treatment or involve patients or volunteers in teaching or research.

 

n. The GP Locum shall maintain records that contain personal information about patients, colleagues or others securely, and in line with any data protection requirements.

 

 

7. GP LOCUM WARRANTIES

 

7.1. The GP Locum warrants as below, both at the time of entering into these terms and for the duration of each and every Engagement:

 

a. that the GP Locum is legally entitled to live and work in the United Kingdom;

 

b. the information provided to the Client and Bookamed (via the Platform or otherwise) for the purposes of the Engagement are correct and true;

 

c. the GP Locum holds valid and full registration and GP registration with the General Medical Council and is on the register of the same;

 

d. the GP Locum is on the NHS national performers’ list (or other such relevant list);

 

e. the GP Locum possess a valid JCPTGP/PMETB/CCT (or equivalent) certificate;

 

f. that (if the GP Locum has any restrictions on their licence, and/or is subject to any disciplinary proceedings or ongoing performance review) that they have explicitly drawn this to the attention of both Bookamed and any Client before their Engagement commences;

 

g. that he/she possesses the experience, training, qualifications and any authorization required by law or a professional body the Client considers necessary or which are required by law to work in the Engagement;

 

h. that he/she has not been convicted of a criminal offence (other than traffic violations) which would reasonably affect the Client’s decision to permit access to Client systems or to provide his/her Services;

 

i. that if, at any time prior to the start of the Engagement, the GP Locum has, receives or obtains any information which indicates that the GP Locum is or may be unsuitable to perform the GP Locum services for the Client, the GP Locum shall pass such information to the Client immediately, and co-operate fully with any further enquiries the Client (or any agent of it) may make in connection with that information;

 

j. by entering into this Agreement he/she will not be in breach of any obligations which he/she owes to any third party or is not otherwise prevented from carrying out its obligations under this Agreement;

 

k. if, either before or during the course of an Engagement, the GP Locum becomes aware of any reason, why he/she may not be qualified to provide Services during any Engagement, he/she shall notify the Client immediately of such disqualification;

 

l. the GP Locum shall co-operate in verification either directly by the Client or any third party of any information or any documentation provided by the GP Locum, including but not limited to, their identity, their right work in the UK, their qualification and professional registration, employment history and references, DBS check and occupational health;

 

m. that he/she is not subject to any proceedings or review by any Primary Care Trust, the General Medical Council, the National Clinical Assessment Service, either ongoing or concluded which may be relevant to the Engagement;

 

n. the GP Locum shall hold valid medical indemnity insurance (including out of hours work cover where applicable), relevant professional indemnity cover, public liability insurance, and any other forms of insurance reasonably required by Bookamed from time to time;

 

o. that (in completing each and every timesheet or in providing related supporting formation) the GP Locum confirms that the information he/she has given form is correct and complete and that he/she have not claimed elsewhere for the hours/session detailed. The GP Locum understands that if he/she knowingly provides false information this may result in disciplinary action and he/she may be liable to prosecution and civil recovery proceedings. The GP Locum consents to the disclosure of information from the timesheet and / or related supporting information to the Client, Bookamed, and the NHS Counter Fraud and Security Management Service for the purpose of verification of this claim and the investigation, prevention, detection and prosecution of fraud; and

 

p. that he/she will comply with the terms of any policies and procedures of the Client applicable to the role and which are drawn to its attention by the Client.

 

7.2. The GP Locum agrees that, in accepting these terms and conditions, it is agreeing that:

 

a. based on the information the GP Locum has provided, Bookamed will generate timesheets;

 

b. based on the timesheets, Bookamed will generate invoices and will send them to the Client; and

 

c. (where applicable and where Bookamed is providing services in relation to pensions form completion) the GP Locum consents to Bookamed completing the necessary pensions forms and obtaining signatures where required from the Client in relation to them.

 

8. ENGAGEMENT

 

8.1. The GP Locum is not obliged to accept any Engagement offered by a Client.

 

8.2. If the GP Locum is unable for any reason to provide the Services to a Client during the course of the Engagement, the GP Locum shall inform the Client and Bookamed of this as soon as reasonably possible.

 

8.3. The GP Locum shall not engage in any conduct detrimental to the interests of Bookamed or its Clients, which includes any conduct that could create any liabilities for Bookamed and/ or bring Bookamed or its Client into disrepute, for example, the repeated cancellation of Engagements whether before or during an Engagement without good reason and/or with limited notice.

 

8.4. The GP Locum shall not at any time divulge to any person, nor use for his / her own benefit or any other person’s benefit, any confidential information relating to the Client’s or Bookamed’s employees, business affairs, transactions or finances.

 

9. JOB SEARCH, TIMESHEETS, PENSION FORMS

 

9.1. The process for registration, vacancy searches, invoicing and time-sheets etc., is set out in Annexure 3.

 

9.2. If the GP Locum is a private limited company, then it will not be eligible to receive a pension from the Client for the provision of the Services.

 

9.3. If the GP Locum is self-employed then he/she may be eligible to receive a pension benefit from the Client for the provision of the Services and the GP Locum should therefore indicate whether or not he/she is interested in such a benefit when creating the User Account.

 

10. LIABILITY

 

10.1. The GP Locum shall be fully liable for and shall indemnify Bookamed and its affiliates, directors, officers, employees, sub-contractors, agents and assignees against any costs, losses, liabilities, damages, claims or proceedings resulting directly or indirectly from his/her:- use of the Platform, application for an Engagement, acts or omissions during the course of an Engagement, assertion/claim that he/she is an employee, partner or agent of Bookamed, and breach of any of these Terms.

 

11. TERMINATION

 

11.1. Bookamed reserves the right, at its sole discretion, to immediately terminate the Agreement and suspend the GP Locum’s access to the Platform with or without notice if any content or information provided the GP Locum is found to be inaccurate, misleading, defamatory or false; or the GP Locum has violated any of the Terms including bringing Bookamed or any of its Clients into disrepute.

 

11.2. Subject to clause 12.3, either party may terminate this Agreement on giving at least three months’ notice in writing to the other party.

 

11.3. A GP Locum may give notice to terminate his or her subscription to the Premium subscription service (and revert to the Basic, free, service). Notice under this clause 12.3 shall be a minimum of five business days and must be given in writing (in paper form or by suitable electronic means) to Bookamed. If notice is given in this way, the rest of these terms and conditions still apply for the other services and the GP Locum may opt to go back to the Premium subscription at any time, by giving notice to Bookamed and on payment of the required subscription fee for that service.

 

12. MISCELLANEOUS

 

12.1.Relationship

 

Bookamed and the GP Locum agree that notwithstanding anything to the contrary contained herein, the relationship between them shall be a principal to principal relationship and nothing contained herein shall be deemed to construe either party to be the agent, servant, partner, joint venture partner, subsidiary, associated or group company of the other party.

 

12.2. Entire Agreement

 

a. This agreement constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

 

b. Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement. Each party agrees that it shall have no claim for innocent or negligent misrepresentation based on any statement in this agreement.

 

12.3. Variation

 

Bookamed reserves the right to update these terms and conditions from time to time to reflect changes in the business operating model, regulation, and any other factors that may influence the delivery of services. In such occasions, Bookamed shall inform the Client in writing via email or letter. By continuing to use the services after being notified of the changes, the Client shall be deemed to have accepted the changes.

 

12.4. Waiver

 

A waiver of any right or remedy is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default. A delay or failure to exercise, or the single or partial exercise of, any right or remedy shall not:

 

a. waive that or any other right or remedy; or

 

b. prevent or restrict the further exercise of that or any other right or remedy.

 

12.5. Severance

 

If any provision or part-provision of this agreement is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this agreement.

 

12.6. Notices

 

a. Any notice or other communication given to a party under or in connection with this agreement shall be in writing, addressed to that party at its registered office or such other address as that party may have specified to the other party in writing in accordance with this clause, and shall be delivered personally, or sent by pre-paid first class post or other next working day delivery service, commercial courier, fax, or email.

 

b. A notice or other communication shall be deemed to have been received: if delivered personally, if sent by pre-paid first class post or other next working day delivery service, at 9.00 am on the second Business Day after posting; if delivered by commercial courier, on the date and at the time that the courier's delivery receipt is signed; or, if sent by fax or email, one Business Day after transmission.

 

c. The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.

 

12.7.Third party rights

 

No one other than a party to this agreement shall have any right to enforce any of its terms.

 

12.8. Governing law

 

This agreement, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by, and construed in accordance with the law of England and Wales.

 

12.9. Jurisdiction

 

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.

 

12.10. Dispute Resolution

 

In the event of a dispute between the parties in relation to the terms of this agreement or their application, the parties shall use their reasonable endeavours to resolve the dispute between themselves. If this fails to resolve the issue within 30 days, then the parties will attempt to settle it by mediation in accordance with the CEDR Model Mediation Procedure, with a mediator to be selected by CEDR and each party sharing the costs equally of the mediation unless they shall agree otherwise. Neither party may commence any court proceedings in relation to the whole or part of the dispute until 30 days after service of the ADR notice, provided that the right to issue proceedings is not prejudiced by a delay.

Notes:

1 GP Locums subscribing to Basic Subscription plan shall be provided with paper based timesheet templates for recording and obtaining approval of time worked. The GP Locum shall liaise directly with the Client and obtain approval of timesheets.

ANNEXURE – 3

 

REGISTRATION, VACANCY SEARCH, TIMESHEETS,

INVOICING AND PENSION FORM PROCESS

 

1. REGISTRATION

 

1.1. Bookamed is an online and mobile recruitment platform to post and search assignment opportunities for Clients and GP Locums. The Platform shall provide additional services including submission and verification of timesheets, generating weekly and monthly invoices on behalf of the GP Locums, providing the Clients and the GP Locums with monthly statements of all invoices, and (where applicable) generating NHS Pension Form A (collectively referred to as the “Bookamed Platform Services”).

 

1.2. To avail the services of Bookamed, the GP Locum must register an account through the Bookamed website (“User Account”). The GP Locum shall provide certain information, including, without limitation, contact details of the GP Locum, specialty, knowledge of IT systems, self-employed or private limited company status (“GP Locum Information”). The GP Locum shall from time to time update the information as and when necessary. On registration, the GP Locum shall be bound by these terms and the General Terms and Conditions of the Platform.

 

1.3. The GP Locum can list themselves on the Platform after creating the User Account and providing the GP Locum Information.

 

2. VACANCY LISTING

 

2.1. Upon creating the User Account, Bookamed shall provide the GP Locum access to search and apply for vacancies.

 

2.2. The GP Locum represents and warrants that the details provided on the Platform in relation to his or her profile for the purpose of the Engagement shall be accurate and true at all times.

 

2.3. Bookamed shall not be responsible for any information provided by the GP Locum in relation to the Engagement on the Platform.

 

3. TIMESHEETS

 

Premium Plan Subscribers

 

3.1 The GP Locum shall submit his/her timesheets on the Platform for the services performed for the Client at the end of each day. The GP Locum shall in any case submit his/her timesheets by end of each day (i.e. by every Friday of the week before midnight or by the starting of the next week (i.e. by every Monday of the subsequent week before 12pm) (“Timesheet Submission Date")

 

3.2. The Client shall validate and confirm the timesheets of the GP Locum at end of each day or by the starting of the next week (i.e., by every Monday of the subsequent week before 8 pm.) and in any case within 7 (seven) days from the Timesheet Submission Date (“Timesheet Validation Date”).

 

3.3. If the Client fails to validate the timesheets within 7 (seven) days from the submission of the timesheets by the GP Locum, the timesheets submitted by the concerned GP Locum shall be deemed valid and payable. In case any discrepancy is found in the timesheets by the Client, the GP Locum shall provide requisite clarification to the Client. The Client and the GP Locum shall mutually settle any discrepancy relating to the timesheets.

 

Basic Plan Subscribers

 

3.4. GP Locums subscribing to Basic Subscription plan shall be provided with paper based timesheet templates for recording and obtaining approval of time worked. The GP Locum shall be directly responsible for completing, submitting and getting approval of timesheets from the Client.

 

4. INVOICING

 

Premium Plan Subscribers

 

4.1. When weekly invoicing is preferred by the Client, if the GP Locum fails to submit the timesheet for any day during the week before the Timesheet Submission Date, then no invoice shall be raised by Bookamed on behalf of the GP Locum for such pending timesheets, until the same is submitted on the Platform and approved by the client. However, once the pending timesheets for any week are submitted on the Platform and approved by the client, the invoices for such timesheets will be raised along with the invoice for the subsequent week.

 

4.2. When monthly invoicing is preferred, if the GP Locum fails to submit the timesheet for any day during the month before the last day of the month, and the client fails to approve any of the timesheets for the month before the last day of the month, then no invoices shall be raised for such pending timesheets by Bookamed on behalf of the GP Locum, until the same is submitted on the platform. However, once the pending timesheets for any month are submitted on the Platform and approved by the client, the invoices for such timesheets will be raised along with the invoice for the subsequent month.

 

4.3. The GP Locum hereby agrees that Bookamed shall have no liability in the event of an error being made in the invoicing process. However, if Bookamed is notified by either the Client or the GP Locum of an error, it shall use its reasonable endeavors to rectify the error and issue a new invoice to replace the incorrect one.

4.4. The GP Locum shall make own arrangements to create invoices and send to the Client for approval

 

5. PENSIONS

 

Premium Plan Subscribers

 

5.1. (Where applicable) Bookamed platform shall automatically generate NHS pension form A on the eighth day of the month for the previous month. The GP Locum agrees to review and digitally sign Pension Form A and send to the Client for approval via the platform within three days of receiving the form.

 

5.2. The Client agrees to review, digitally sign and return the NHS pension form A to the concerned GP Locum within three days of receiving his/her signed form.

 

Basic Plan Subscribers

 

5.3. The GP Locum shall make own arrangements to fill pensions forms A and obtain signatures from the Client
